The mediation process
Here is what you can expect when you begin. The initial consultation is free and lasts 60 minutes. The timing, participants, fees, and deliverables for later stages are agreed for your situation; not every matter proceeds through every stage.
1. Intake and consultation
Briefly describe the type of issue, who is involved, and what you hope to discuss. Explore suitability, accessibility needs, and whether another professional or process is needed. The next step is a decision about whether and how to proceed.
2. Agreement to mediate
Before paid mediation begins, review the proposed scope, fees, roles, confidentiality terms and limits, and participation arrangements. Raise questions before signing. A booking alone does not establish an agreement to mediate.
3. Preparation
Prepare your priorities, questions, and possible options. Agree on what information is needed and how to share it; do not upload sensitive documents to public website forms. Preparation helps establish an agenda and session arrangements.
4. Mediation session
Meet in person as arranged or online throughout Ontario. Share perspectives, explore issues, and consider options with the mediator’s guidance. Participants make their own decisions; no agreement is guaranteed. Session length is agreed in advance and can be reviewed as needed.
5. Resolution and documentation
If agreement is reached, discuss the appropriate written record within the agreed scope. A summary or Memorandum of Understanding can record the terms discussed; it is not automatically a court order. Obtain independent legal advice about legal effect and further steps.
6. Optional follow-up
Discuss whether a later check-in or coaching session would be useful. Agree on timing, scope, and fees before additional work. Follow-up can review practical questions and possible next steps.
